Selling a Home in a 55+ Community in Palm Beach County: Approval, Timeline, and Common Delays
By Brian Perry, Perry Home Solutions of Keller Williams Innovations. Updated Nov 4, 2026.
TL;DR: Selling in a 55+ community adds an association step. The buyer applies, the association confirms age and any approval its rules require, and the title company orders an estoppel certificate. Start that paperwork early and build the approval time into your closing date, and most delays go away.
Key takeaways
- Under federal rules, at least 80% of occupied units in a 55+ community must have at least one resident 55 or older.
- Your association's documents decide whether the board must approve the buyer and how long it has.
- Under Florida law, the association must issue an estoppel certificate within 10 business days of a request.
- Incomplete applications, open violations, and unpaid assessments are the usual hold-ups.

What is the 55+ age rule?
The Housing for Older Persons Act lets a community operate as 55+ housing if at least 80% of occupied units have at least one person 55 or older. The community must publish and follow policies showing that intent, and verify ages. It must update age records at least every two years. A driver's license, passport, or signed certification can count as proof.
A lot of buyers think the 80/20 rule means the association has to approve someone under 55 as long as fewer than 20% of homes have a younger resident. That is not how it works. The 80% is a floor, not a promise of open spots. Federal rules let each community set stricter age rules in its own documents, and many in Palm Beach County require every buyer or resident to be 55 or older. If the documents say no one under 55, the association can deny the application, even if the 20% is not used up. Before you write an offer or list your home, read the age rules in the community documents or ask the association. This is general information, not legal advice.
How does buyer approval work in a 55+ community?
- Read your documents. Find the section on sales or transfers. It sets any application, notice period, interview, or right of first refusal.
- Get the application package early. Share it with buyers along with the listing details.
- The buyer applies after contract. Age proof goes in here.
-
The estoppel certificate is ordered. The association must issue it within 10 business days of a request. It shows dues owed, transfer or capital contribution fees, open violations, and whether board approval is required and given.
-
Approval, then closing.
How long does it take to sell in a 55+ community?
In Boynton Beach and Delray Beach, 1,910 homes in 55+ communities sold from November 2025 through October 2026. The median time from contract to closing was 35 days, and the median sale price was 96.4% of the last list price (Beaches MLS data, pulled Oct 31, 2026).
The approval window comes from your community's documents. Put it in the contract so closing does not land before the board meets.
What slows down a 55+ home sale?
- The buyer's application is late or incomplete.
- An open violation on the home, like an unapproved change.
- Unpaid dues or assessments that show up on the estoppel.
- The board only meets on a set schedule.
- A right of first refusal that the association has to waive.
- Seasonal owners who are out of state when signatures are needed.

FAQ
Can a 55+ community turn down a buyer for a reason other than age? It still has to follow fair housing law. The 55+ exemption covers familial status only. It does not allow discrimination based on race, color, religion, sex, disability, or national origin (HUD fair housing guidance, checked Oct 28, 2026).
Who orders the estoppel certificate? Usually the title company or closing attorney, on the owner's behalf.
Can I sell to a buyer under 55? Some communities allow a limited share of units without a 55+ resident. Your community's rules decide. Ask the association before you accept that offer.
Do I need to be in Florida to sell? No. Many sellers sign remotely. Plan ahead for any documents that need a notary.
